P.P., Mr. Partha Pratim Das, Ms. Manasi Roy ...... for the State The present application has been preferred under Section 439 of the Code of Criminal Procedure in connection with Bhupatinagar Police Station Case no.129 of 2020 dated 01.09.2020 under Sections 498A/304B/34 of the Indian Penal Code.

Mr. Jana, learned advocate appearing for the petitioner submits that there was a love-affair between the petitioner and the victim girl. They eloped and married on 13th August, 2020. No incriminating material is on record against the petitioner. Upon completion of investigation charge-sheet has already been filed.

Mr. Jana informs this Court that the petitioner surrendered and obtained interim bail for appearing in the examination. After the specified period, the petitioner had surrendered.

Mr. Mukherjee, learned Public Prosecutor appearing for the State submits that there are five accused, out of which four excluding the petitioner are absconding. There had been a claim towards dowry of Rs. 12,00,000/- and as such the petitioner is not entitled to relief, as prayed for.

Having heard the learned advocates appearing for the respective parties and upon considering the materials in the case diary, the gravity of the offence and the extent of complicity of the petitioner in the alleged offence, this Court is not inclined to grant bail.

The application for bail being C.R.M. 106 of 2021 is, accordingly, dismissed.
