None appears for the State and respondent nos. 7 & 8 despite service.
Mr. Wasim Ahmed who usually appears for the State and is present in Court, is requested to represent the State in the matter. His appointment be regularized by the appropriate authority.
The petitioner is directed to serve copy of the writ petition along with annexure thereto upon Mr. Ahmed in course of this day.
Learned counsel for the petitioner submits that despite an order of status quo granted by the learned Trial Court upon both the parties, the private respondents are trying to raise construction in the property in question
forcibly and illegally. Complaint lodged before the police authority has not been considered.
Learned counsel submits that during pendency of the writ petition, FIR has been registered. Investigation is in progress.
Learned counsel for the 6th respondent denies and disputes the allegations made by the petitioner. In view of the fact that the FIR has been registered and investigation is in progress the investigating officer is directed to conduct the investigation in a fair and unbiased manner and take the same to its logical conclusion in accordance with law.
In the meantime, the police authority shall keep strict vigil in the area in order to avoid any untoward incident and shall ensure maintenance of peace and tranquility.
The writ petition is disposed of accordingly. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
