And In Re : Sarathi Das Bagdi alias Sarathi Bagdi & anr. .... petitioners Mr. Ritam Chowdhury ....for the petitioners Mr. Swapan Banerjee, Ms. Purnima Ghosh ...... for the State The present application has been preferred under Section 439 of the Code of Criminal Procedure in connection with Mayureswar Police Station Case no.244 of 2019 dated 19.12.2019 under Sections 302/201 of the Indian Penal Code. Mr. Chowdhury, learned advocate appearing for the petitioners submits that the petitioners have been falsely implicated in the criminal proceedings. Upon completion of the investigation, charge-sheet has already been filed and the petitioner no.1 is in custody for 169 days and the petitioner no.2 is in custody for 159 days.

Mr. Banerjee, learned advocate appearing for the State opposes the prayer for bail and submits that there are incriminating materials-on-record.

Having heard the learned advocates and upon considering the materials in the case diary, the extent of complicity of the petitioners in the alleged offences, we are not inclined to grant bail.

The application for bail being C.R.M. 112 of 2021 is, accordingly, dismissed.
