On the earlier occasion on the prayer of the learned counsel representing the appellant, time to file the substitution application was extended for two weeks from 29th November, 2022.

The department has reported that no such application is filed in the department within the aforesaid time.

In view of failure to file substitution application within the aforesaid time, the appeal stands dismissed as abated.

There will be no order as to costs.
