We have heard the learned advocates appearing for the respective parties and considered the materials in the case diary. Prima facie the case is based upon circumstantial evidence and the involvement of the petitioner in the alleged offence cannot be totally ruled out. Considering the gravity of the offence and since investigation is still continuing, we are not inclined to exercise discretion in his favour and as such his prayer for anticipatory bail is refused.

Accordingly, the application for anticipatory bail being C.R.M.(A) 37 of 2022 is dismissed.
