Satyajit Das v. State Of West Bengal
(AD/ Subr ata) 06.01.2022 C.R.M. (DB) 35 of 2022 (Via Video Conference) Court No.29 (Rejected) In Re: - An application for bail under Section 439 of the Code of Criminal Procedure in connection with Pandua P.S. Case No.35 of 2012 dated 22/02/2012 under Sections 392 of the Indian Penal Code and Section 25/27 of the Arms Act. And In the matter of: Satyajit Das ....petitioner.
Mr. Angshuman Chakraborty ...for the petitioner.
Ms. Trina Mitra ... for the State.
The petitioner is in custody for four years and eleven months. It is submitted while he was on bail he was implicated in another case involving narcotic substance and arrested. As a result, he could not appear in the present case. Subsequently, warrant of arrest was issued and was re-arrested in the present case. He prays for bail.
We have considered the materials on record. There are ample evidence connecting the petitioner with the alleged robbery. He has criminal antecedents. In view of the above facts, we are not inclined to grant the petitioner bail. However, keeping in mind the period of detention suffered by the petitioner, we direct the trial court to conclude the trial at an early date preferably within one year from the next date fixed before the trial court for recording evidence without granting unnecessary adjournment to either of the
parties.
Accordingly, the prayer for bail of the petitioner is rejected.
C.R.M. (DB) 35 of 2022 is, thus, dismissed.
