The petitioner is aggrieved by the manner in which the proceedings being Habra P. S. Case No. 196 dated 17.04.2011 under Sections 498A/406/34 of the Indian Penal Code is progressing before the learned Judicial Magistrate, 1st court, Barasat, North 24 Parganas.

Learned advocate for the petitioner submits that the case was initiated in the year 2011 and after the investigation was concluded, charge was framed in the year 2016 but till date no witness has been examined.

I have considered the anxiety of the petitioner and I direct the petitioner to effect service upon Mr. Sanjib Kumar Dan, learned advocate who ordinarily appears on behalf of the State. His appointment may be regularized by the concerned authorities in due course.

Having regard to the manner in which the proceedings are progressing before the learned Magistrate, I direct that the learned Magistrate on and from the next date would fix at least one date in a month for evidence of the present case so that the trial of the case can be taken to its logical conclusion within a reasonable period of time. No unnecessary adjournments should be granted to either of the parties. All efforts must be taken to conclude the trial at the earliest.

With the aforesaid observations, the present revisional application being CRR 31 of 2023 is disposed of. All Pending applications, if any, are disposed of accordingly. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
