The writ petitioner is a Fitter Mechanical at Parbelia Colliery of Eastern Coalfields Limited. He claims that he is medically unfit and seeks retirement on such medical grounds and in his place, he seeks appointment of his son, Ranjoy Paswan.

Counsel for the petitioner has produced an order dated 15th January, 2021 i.e. issued after filing of the writ application.

By the said letter, issued by the Area Medical Officer, Sodepur, Eastern Coalfields Limited, the petitioner was asked to attend a Medical Board along with all treatment papers and other relevant documents.

In those circumstances, since the main prayer of the writ petitioner has already been addressed by the Eastern Coalfields Limited, no further order need be passed in this writ application.

It is made clear that the petitioner shall attend the Medical Examination to be conducted by the Area

Medical Board, Sodepur as has been directed by the Eastern Coalfields Limited along with all relevant documents as submitted in the letter dated 15th January, 2021.

In so far as the prayer for employment of his son is concerned, the same is premature at this stage. The same shall be considered, if necessary, after the findings are given by the Medical Board in question. With the aforesaid observations, the instant writ application shall stand disposed of.

There will be no order as to costs.

All parties are directed to act on a server copy of this order on usual undertakings.
