And In Re : Akram Mondal ......Petitioner Mr. Ashok Kumar Chowdhury ....For the Petitioner Mr. Sanjoy Bardhan Mr. Palash Chandra Majhi .......For the State The present application under Section 439 of the Code of Criminal Procedure has been preferred by the petitioner in connection with Bongaon Police Station Case No. 690 of 2019 dated 15.09.2019 under sections 21(C)/29 of the N.D.P.S. Act. The learned advocate appearing for the petitioner submits that upon completion of investigation, charge sheet has already been filed and the petitioner is in custody for more than 16 months.

The learned advocate appearing for the State opposes the prayer for bail and submits that there had been recovery of the contraband substance from the petitioner and the charge sheet along with a chemical report has been filed. Upon considering the materials in the case diary, gravity of the offence and the extent of complicity of the petitioner in the

alleged offence, we are not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner is rejected.

The learned Trial Court is, however, directed to take the trial to its logical conclusion within a reasonable period of time. With the aforesaid observations, the application for bail, being CRM No. 129 of 2021, is dismissed.
