.........for the WBSEDCL In an earlier round of writ petition being W.P. 15037(W) of 2017, by an order dated 08.02.2018 a Co-Ordinate Bench in respect of the very same bill dated 29.04.2017 had remanded the matter to the GRO/CGRO.

It is admitted position that no final order of the GRO/CGRO has been passed till date.

On the other hand, on the basis of the draft order passed by the GRO/CGRO, the petitioner had approached the Ombudsman who had passed a draft order and then a final order.

The grievance of the writ petitioner in this proceeding pertains to a final settlement order passed by the Ombudsman. By the impugned order, the Ombudsman had remanded the entire matter to

the GRO/CGRO to pass a reasoned order. There has been no final adjudication till date.

In view of the fact that the initial order of the GRO/CGRO has never been passed, all proceedings taken subsequent thereto are misconceived and not maintainable.

WPA 354 of 2026 stands disposed of by directing the GRO/CGRO to pass a final order in terms of the directions of the Co-Ordinate Bench dated 08.02.2018.

Incidentally, a staggering amount of Rs.

4,50,000/- which though disputed remains unpaid till date. The petitioner has been pursuant frivolous proceedings with the obvious intent to procrastinate matters. The repeated attempts in challenging draft orders are untenable and based on an erroneous appreciation of the law.

There is no stay nor embargo of any kind of whatsoever in WBSEDCL pursuing its remedies insofar as any unpaid bill is concerned. In view of the above, the WBSEDCL is at liberty to take all steps for recovery of their dues in accordance with law, if so advised.

The GRO/CGRO is directed to complete the exercise in term of the earlier direction of Court within a period of four weeks from the date of communication of this order.

In such circumstances, WPA 354 of 2026 stands dismissed. However, there shall be no order as to costs.
