2. We have heard the learned advocate for the respondent no.7.

3. It is submitted by the learned advocate for the respondent no.7 that the appeal itself has become infructuous because the order and direction issued by the learned Writ Court in the impugned order has been implemented and the bids were directed to be reconsidered and the appellant had participated and he was declared as a successful bidder and the 7th respondent has filed a writ petition challenging the award of tender in favour of the appellant and the same is pending.

4. In the light of the same, the appeal is dismissed.

5. There shall be no order as to costs.

6. Urgent photostat certified copy of this order, if applied for, be furnished to the parties expeditiously upon compliance of all legal formalities.
