Learned advocate appearing on behalf of the municipality has placed a statement before this Court and would submit that the municipality has disbursed a sum of Rs. 3,30,000/- to the petitioner on account of outstanding gratuity amount. He submits that the municipality seeks two months time to regularize the pension account and make payment of arrear pension to the petitioner.

2. 2. Having regard to the above, I am of the view that at this stage there is no scope to retain the writ petition on the file any longer. The writ petition thus stands disposed of with a direction upon the municipality to make payment of interest @7 per cent on the admissible gratuity amount which has been belatedly disbursed by computing the interest from the date when the petitioner had retired till such time the same has actually been disbursed. In so far as arrear pension is concerned since the municipality submits that the same shall be disbursed within a period of two months by recording such submission, no further order is passed at this stage. Any relief which the petitioner may be entitled in law may also be disbursed.
