I find from the records that the case is of the year 2009 and till date the same is continuing. Last of the order-sheet reflects that the case has been fixed for further cross-examination of P.W.1. Having regard to the time period which has elapsed in the meantime and there are only six witnesses to be examined, I direct that the learned trial court on and from the next date will fix one date in a month for the trial of the case so that the trial of the case can be taken to its logical conclusion within a reasonable period of time. It has been submitted that the petitioner is suffering from acute osteoarthritis as also gynaecological problems and, as such, there may be physical hindrances for the petitioner to stand for an hour or so.
Learned trial court will see to that no unnecessary harassment is further created to the present petitioner under the garb of lengthy cross-examinations. Petitioner would put all efforts to appear on the next date so fixed and cross-examination be closed on the said date so fixed or on the next day. It is reiterated that the trial of this case will continue before the jurisdictional court in spite of any resolution taken by the local bar. No unnecessary adjournment be granted to any of the parties on the aforesaid ground. All stakeholders would cooperate with the trial court to conclude the trial at the earliest.
With the aforesaid observations, CRR 33 of 2024 is disposed of.
Pending connected application, if any, is consequently disposed of.
