The writ petitioners complain that the private respondent/tenant is obstructing them from effecting repairs in respect of the subject premises.

Bantra Police Station has filed a report dated 09.03.2023 and the same is taken on record.

It appears that there is a long standing civil dispute between the petitioners and the private respondent. There is a Title Suit No. 15 of 2022 pending before the learned Civil Judge (Junior Division), 7th Court, Howrah in respect of the property, filed by the private respondent against the petitioners.

In view of the above, the petitioners may seek appropriate relief before the Civil Court in this regard. Bantra Police shall, however, ensure that there is absolutely no breach of peace in the area.

The writ petition is disposed of.

There will be no order as to costs.
