None appears on behalf of appellant. On 15th July, 2021 following order was made.

"The second appeal tender is of year 2006. Ms. Mitra, learned advocate appears on behalf of appellant and submits, CAN 6168 and 6169, both of 2010 are pending.

We have perused the file and find by order dated 15th September, 2010, the learned single Judge had dealt with the applications. We reproduce, inter alia, following from said order:- "Having heard the learned Advocates appearing for respective parties, the applications are disposed of by condoning the delay in filing of the present application and by directing that the respondent-opposite party nos. 6(a) to 6(f) be added as respondent nos. 6(a) to 6(f) in the cause title of the Memorandum of Appeal."

We have ascertained, amendments have been made to add respondent nos. 6(a) to 6(f) in the appeal. As such the appeal is to be moved for admission. Ms. Mitra prays for adjournment.

List on 22nd July, 2021. It is made clear no further adjournment will be granted. In event appellants go unrepresented on adjourned date or thereafter, the appeal is likely to be dismissed."

The appeal has been listed and the contingency of appellant going unrepresented has happened.

S.A. 144 of 2009 is dismissed.
