The petitioner submits that the post of Manager in Khagda Samabay Krishi Unnayan Samity Limited was advertised in which he participated. Despite the selection process having been completed, results have not been published.

Counsel for the Society would submit that there was procedural impropriety in the process of advertisement and recruitment, inasmuch as, Rule 105, which directed publication in State Level Newspaper, has not been done. He further submits that the employment exchange was also not notified seeking sponsor of the candidates.

It is submitted by Counsel for the respondent no.6 that the decision to cancel the earlier recruitment process was taken in March 2020 but fresh process could not be initiated by reason of the intervening Pandemic.

It is further submitted by him that ARCS was approached by the petitioner and in the said proceeding, the Society had apprised the above. This Court, therefore, directs the Society to complete the process of publication and intimation to the employment exchange of the recruitment to the post of Manager within 15 days from date. Rule 105 shall be strictly complied with in letter and spirit by the Society.

The petitioner shall be entitled to participate in the new recruitment process.

The entire process of recruitment after strictly following the Rules in question shall be completed by the Society within two months from date.

With the aforesaid directions, the instant writ petition shall stand disposed of.

There will be no order as to costs.

All parties are directed to act on a server copy of this order on usual undertakings.
