Affidavit-of-service filed in Court today be taken on record.

The Sub-Divisional Police Officer (S.D.P.O.), Lalbagh, Mr. Bikram Prasad, submits that his report dated 10th January, 2023 was submitted to the State Advocate but was not filed.

A copy of the said report has now been produced before this Court and the same is taken on record. The said report of the S.D.P.O., clearly indicates that the disputes between the petitioners and the private respondents are related to demarcation of certain lands.

This Court is of the view that the petitioners and/or the private respondents may take out appropriate civil or statutory proceedings in that regard.

The S.D.P.O. has taken out proceedings under Section 107 of the Code of Criminal Procedure and rightly so. It was apprehended by the S.D.P.O. that there might be breach of peace in respect of the

disputes between the petitioners and the private respondents.

The S.D.P.O., Lalbagh shall ensure that there is absolutely no breach of peace in the area. The S.D.P.O. has given clear and precise instructions which is appreciated by this Court.

With the aforesaid directions, the instant writ petition shall stand disposed of.

There will be no order as to costs.
