SA-269 of 2008 25.01.2023 Item no.3 Court No.50 Ms Bina Baidya, Learned Advocate appeared for the appellants.

Perused the office report dated 18.01.2023/24.01.2023, the substitution application being CAN-5/2022 filed by the Learned Advocate for the appellants.

CAN-5/2022 is taken up for hearing this day. It appears from the aforesaid that CAN-5/2022 was filed by the Learned Advocate for the appellants consequent to the death of the respondent no.1 Chandra Nath Mukherjee and praying for bringing the legal heirs in place and stead of the deceased respondent no.1.

The substitution application being CAN- 5/2022 is within time and in accordance with law, therefore the same is allowed as well as disposed of.

Let the legal heirs of the deceased respondent no.-1 be substituted as the respondent no.

nos. 1(a) and the respondent no. 2 who is already on record as per the averment made in the said application. The department is directed to amend and make note in the cause title of the memorandum of appeal accordingly.

The Learned Advocate for the appellants is directed to file the postal costs, written up notice forms for service of notice of appeal upon the respondent no.-2 and the substituted respondent no.1(a), within two weeks from this date. (Umesh Singh) Registrar Administration (L&OM)
