The petitioner renews his prayer for bail and submits that he is in custody for 404 days. It is submitted on behalf of the petitioner that co-accused Uttam Ghosh has been enlarged on bail.

Learned lawyer for the State opposes the prayer for bail. We have considered the materials on record. The petitioner stands on the same footing with co-accused Uttam Ghosh, who has been enlarged on bail.

Under such circumstances and in view of the period of detention suffered by the petitioner, we are inclined to grant bail to the petitioner.

Accordingly the petitioner be released on bail upon furnishing a bond of Rs. 10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of

the learned ACJM, Krishnagar on condition that the petitioner shall appear before the trial court on every date of hearing and shall not intimidate witnesses or tamper with evidence in any manner whatsoever.

In the event he fails to appear before the trial court without justifiable cause, the trial court shall be at liberty to cancel his bail without reference to this court. The application for bail is disposed of.
