Learned advocate for the petitioner submits that 748 grams of heroin were allegedly recovered from the possession of the present petitioner and he is in custody for 2 years. Till date only 4 witnesses have been examined and the seizure list witnesses have turned hostile.

Learned advocate for the State, on the other hand, draws the attention of the Court to the order dated 05.08.2025 in CRM(NDPS) 616 of 2025.

I find that such contention was considered by the coordinate Bench. This Court also examined the further witnesses (P.W.5 to P.W.8) and is of the opinion that there is hardly any similar circumstances.

State submits that they intend to examine four more witnesses.

Having considered the same, I am of the opinion that the rest of the witnesses be concluded by the prosecution by 30th June, 2026. Petitioner will renew the prayer for bail after the said period is over.

Accordingly, CRM(NDPS) 49 of 2026 is dismissed. Learned advocate for the State is directed to communicate this order to the learned special court through the learned public prosecutor conducting trial.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
