The petitioner complains of unauthorised construction raised by the private respondent by encroaching upon P.W.D. land adjoining the petitioner's property, thereby obstructing the egress and ingress of the petitioner. The petitioner seeks liberty to submit representation before the Authority in this regard and prays for direction upon the concerned Authority to consider the representation at the earliest.

In view of the submissions made on behalf of the parties and material on record, the writ petition is disposed of granting liberty to the petitioner to submit a

comprehensive representation before the 5th respondent ventilating his grievances within 7 days from date. The 5th respondent is directed to consider and dispose of the said representation within three months from the date of receipt thereof after affording reasonable opportunity of hearing to all the interested parties including the petitioner and the private respondent, in accordance with law.

With the aforesaid observations and directions W.P.A. 233 of 2022 is disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
