In this contempt application the petitioner complained against the Headmaster by submitting that the Headmaster is taking coercive action against the petitioner which is willful and deliberate violation of the order passed by this court. In their related order dated 13.12.2021 in WPA 19808 of 2021 this court did not pass any mandatory order and it was only requested to the concerned authorities not to take any coercive steps in the meantime against the petitioner. Therefore, as there is no mandatory order against the respondent concerned, I do not think the contempt will lie in this matter. The contempt application is dismissed. However, dismissal of this contempt application will not prevent the petitioner from taking steps by way of other means as may be advised to the petitioner in connection with WPA 19808 of 2021.

A copy of the letter issued by the Deputy Secretary (Academic), West Bengal Board of Secondary Education dated 13.04.2022 raising question as to the service and salary of the petitioner is kept on record. (Abhijit Gangopadhyay, J. )
