Mr. Sushobhan Sengupta with Mr. Subir Paul, learned advocate appears for alleged contemnor. The allegation of contempt in the contempt petition is principally that the reasoned order was not communicated to the petitioners. Petitioners admit that upon notice, hearing given to them and they participated in the hearing.

There are allegations and counter-allegations as would be evident from the compliance report filed by the alleged contemnor and the contentions of the petitioners with regard to service of the reasoned order. Today in court learned counsel appearing for the alleged contemnor has served a compliance report affirmed by the alleged contemnor on April 9, 2025

along with other documents upon the petitioners. Annexure-A at page 11 to the report, is the said reasoned order dated February 27, 2025. Therefore for all practical purposes at least today, the petitioners have been served a copy of the reasoned order dated February 27, 2025, as annexed to the said compliance report. In view of the above, applying the law prevailing on the contempt, this court is of the view that a substantial compliance has been made and taking into account of the consequences and punishments in the contempt proceeding, it appears this court that this contempt proceeding is no more required to be proceeded further. However, the petitioner shall be at liberty to take appropriate steps in accordance with law, if they feel aggrieved with the said impugned order.

Accordingly, this contempt proceeding CPAN 21 of 2025 stands dropped and closed.

The application CPAN 21 of 2025 stands disposed of.
