......Petitioners Mr. Niladri Sekhar Ghosh Ms. Srimoyee Mukherjee ....For the Petitioners Mr. Ranabir Roy Chowdhury Mr. Mainak Gupta .......For the State Apprehending arrest in connection with Arambagh Police Station Case No. 286 of 2019 dated 16.07.2019 under sections 325/307/353/186/332/506 of the Indian Penal Code,1860, read with sections 3⁄4 of the Explosive Substances Act, the petitioners have filed the present application. The petitioner no.1, Sekh Jahidul Islam @ Sk. Aalo, has already been arrested. As such, the present application so far as the said petitioner no.1, Sekh Jahidul Islam @ Sk. Aalo, is concerned, is dismissed as infructuous.

Heard the learned advocates appearing for the respective parties and considered the materials in the case diary. Prima facie, it appears that the extent of complicity of the petitioner no. 2 is similar to that of the co-accused persons, who have already been granted anticipatory bail by a coordinate Bench of this Court by an order dated 30th July, 2019.

In view thereof, we are inclined to grant anticipatory bail to the petitioner no. 2, Paritosh Malik @ Lalu.

Accordingly, we direct that in the event of arrest the petitioner no. 2, namely, Paritosh Malik @ Lalu, shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.

The application for anticipatory bail, being CRM No. 171 of 2021, is, thus, disposed of.
