Hossian ...for the petitioner Petitioner is aggrieved with the order dated 04.09.2025 passed by learned Additional Chief Judicial Magistrate, Chandannagar by which the Court below accepted the report regarding closure of investigation submitted by the Investigating Agency on 4th September, 2025. Being aggrieved by the said order learned Counsel for the petitioner submits that the petitioner/complainant was informed about the submission of final report in the form of closure of investigation at a belated stage and, therefore, he did not get sufficient opportunity to file protest petition against the final report.
He, therefore, seeks a leave before this Court for granting him permission to file a protest petition against the final report submitted by the Investigating Authority. Having heard learned Counsel for the petitioner it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made in the petition, the opposite party will have no cause to prejudice and, as such, the service of copy of application upon the opposite parties is dispensed with.
Having considered the prayer made by the petitioner which appears to be justified, the instant application being CRR 82 of 2026 is
hereby disposed of giving liberty to the petitioner to make a prayer in the form of protest petition before the Court below within a period of 30 days and in the event of filing such application by the petitioner, the Court below will dispose of such application in accordance with law and in accordance with the materials collected during investigation and also the submissions made by the parties without being influenced by any observation made herein.
