For the Petitioners The petitioner is aggrieved by the manner in which Misc. Case No. 145/2022 (CIS No. 156/2022) is progressing before the ld. JM, 3rd Court, Katwa, Purba Bardhaman. Ld. advocate submits that proceedings are under section 125 of the Cr.P.C. and the petitioner/husband has been paying the interim maintenance so awarded very diligently.

However, the evidence of the case is not progressing, although the evidence of P.W.1 has commenced.

According to the ld. advocate on 3.5.2023, 19.7.23 and 16.9.23 no substantial progress could take place and the petitioner is aggrieved by the time which has been consumed in respect of the progress of the case. Having regard to the contentions so advanced, I direct the ld. trial court to fix at least one date in a month for the purpose of the present case and ensure that the evidence is recorded regularly on the date so fixed so that

the trial of the case can be taken to its logical conclusion within a reasonable period of time. No unnecessary adjournment be granted to either of the parties. All efforts be taken for concluding the trial at the earliest. With the aforesaid observations, CRR 42 of 2024 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
