Affidavit-of-service filed by the petitioner is taken on record.

The petitioner is alleging that the private respondents being respondent nos. 7 to 10 are occupying the Government land unauthorisedly which is causing obstruction in supplying their vehicles in the road adjacent to the said Government land. The petitioner prays that they have already given a representation to the District Magistrate and Collector, Purba Medinipur, the respondent no.2 herein for removal of the said unauthorised occupants from the said land.

W.P.A. 252 of 2021 is disposed of by directing the respondent no.2 to consider the representation of the petitioner appearing at the page 38 being annexure P3 to the writ petition in

terms of Section 3 of the West Bengal Public Premises (Eviction of Unauthorized Occupants) Act, 1962 and to dispose it of in accordance with law by a reasoned order. The respondent no.2 shall initiate such proceeding after identifying the land where the private respondents are in occupation at all Government land or not and for the said performance is free to take assistance of the concerned B.L. & L.R.O.

The respondent no.2 shall make all endevour to complete his exercise in this regard within eight weeks from the date of communication of this order.

The petitioner is required to communicate this order along with complete copy of the revisional application to the respondent no.2 within a week from date.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
