It is submitted that the Chairman, Debts Recovery Tribunal, Kolkata has since been appointed by the Notification of the Central Government and he is likely to join day after tomorrow.

In that view of the matter, the instant writ petition is hereby dismissed with liberty reserved to the petitioner to approach the Debts Recovery Tribunal, Kolkata challenging the order of the Presiding Officer, Debts Recovery Tribunal, Visakhapatnam, dated September 6, 2021 passed in S.A. No. 45 of 2021.

Mr. Ranjan Kali, learned Advocate appearing for the writ petitioner prays for extension of the interim order already passed to enable the petitioner to approach the Debts Recovery Tribunal, Kolkata since the order under Section 14 is being pressed for execution.

This Court notes that the interim order dated February 3, 2022 was passed only because the Court was hearing the matter at an initial stage. The order was also passed to ensure that the writ petition is not rendered infructuous.

This Court sees no reason to extend the interim order any further.

There will be no order as to costs.
