Learned advocate for the petitioners is aggrieved by the fact that the prayer for interim reliefs in a proceeding under the relevant sections of P.W.D.V Act in connection with Complaint Case No. C704 of 2022 is pending for more than one and half years. Learned advocate for the petitioner submits that although the affidavit of assets and liabilities have been filed at the instance of the present petitioner but the private opposite parties are avoiding filing of such affidavit and as such the proceedings are being delayed.

It has been informed that the next date has been fixed on 20th February, 2024. Learned Judicial Magistrate, 2nd court, Barasat is directed that in case the private opposite parties adopt dilatory tactics for filing the affidavits, the learned court would proceed and dispose of the application for interim reliefs prayed for at the instance of the present petitioner under Section 23 of the P.W.D.V Act on 29th February, 2024 or within a fortnight thereafter. The learned trial court would stick to the timeline as the petitioner is suffering for a considerable period of time.

With the aforesaid observations, the revisional application being CRR 46 of 2024 is disposed of.
