We have perused the terms. In our opinion, they are lawful. We only observe as a matter of abundant caution that these terms bind the parties only and not any third party.

The Memorandum of Settlement dated 20th June 2023 is taken on record.

We pass a decree according to the above Memorandum of Settlement which disposes of this appeal and also decrees the suit before the learned commercial court at Alipore.

The department is directed to draw up the decree expeditiously.

The parties are directed to take appropriate steps before the learned commercial court at Alipore so that in its records the suit is shown to be decreed in the aforesaid manner.

The appeal and the connected application (CAN No.1 of 2022) are thus disposed of.
