(NDPS) 73 of 2026 In Re : An Application for bail under Section 439 of the Code of Criminal Procedure, 1973 corresponding to Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Jibantala Police Station Case No. 401 dated 07.09.2018 under Sections 21(c)/24/29 and adding Sections 20(b)(ii)(c)/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for 4 years 4 months and other accused persons have already been granted bail. It has been contended on behalf of the petitioner that hardly there has been any progress in the case. As such, petitioner prays for bail on any stringent condition.

Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that eight witnesses have already been examined and the prosecution intends to examine four more witnesses. It has also been brought to the notice of the Court that petitioner is on bail in connection with another case wherein he has been convicted and has been granted bail in a pending appeal.

Having considered the oral circumstances of the case and the fact that there has been alleged recovery from the house of the petitioner also, I am of the opinion that as a matter of last chance, four months' time is granted to the prosecution to complete the examination of four witnesses which the prosecution intends to examine in support of its case.

In case the examination of the witnesses is not over within the next four months, learned Trial Court would release the petitioner on such terms and conditions as it deems fit and proper ensuring further appearance of the accused in course of the trial.

With the aforesaid observations, the application for bail, being CRM (NDPS) 73 of 2026, is disposed of. Report submitted by the learned advocate appearing for the State be kept with the record.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
