The petitioner is the respondent of the Matrimonial Suit No. 955 of 2019 filed by the opposite party seeking dissolution of the marriage between the parties by a decree of divorce.

The petitioner by the present application is praying withdrawal of the said suit pending before the learned District Judge at Howrah and transfer of it to any Court competent to try and dispose of the said suit at Barrackpore under the Judgeship of learned District Judge, 24 Parganas (North) at Barasat on the ground of her inconvenience to attend the said Court at Howrah from her residence at Naihati, District 24Parganaas (North). Howrah is not that far from Naihati for which the petitioner can plead inconvenience in contesting the said suit at Howrah.

The petitioner has failed to make out any ground for withdrawal and transfer of the said matrimonial suit.

C.O. 26 of 2021 and the connected application, CAN 1 of 2021 (not in file), if pending, are therefore, dismissed without any order as to costs.
