And In Re : Raj Kumar Das @ Swapan .... petitioner Mr. Rabi Shankar Chattopadhyay, Ms. Payel Shome ....for the petitioner Mr. Rudradipta Nandy ...... for the State The present application under Section 439 of the Code of Criminal Procedure has been preferred by the petitioner in connection with Polba Police Station Case No.143 of 2020 dated 22.09.2020 under Sections 366A/370/372/373/376/120B/109 of the Indian Penal Code and Sections 3/4/5/6 of the Immoral Trafficking Act and Sections 4/6/8/12/17 of the PCSO Act. Mr. Chattopadhay, learned advocate appearing for the petitioner submits that the petitioner has been falsely implicated and upon completion of investigation, charge sheet has been filed and as such, further detention of the petitioner, who is in custody for 104 days, is not necessary.

Learned advocate appearing for the State opposes the petitioner's prayer for bail and draws our attention to several documents in the case diary.

Having heard the learned advocates and considering the materials in the case diary, the nature of allegations and the extent of complicity of the petitioner in the alleged offence, we are not inclined to grant bail at this stage. The application for bail being C.R.M. No.186 of 2021 is dismissed.
