None appears on behalf of either of the parties. 2.

The second appeal is of 1975. On perusal of the order-sheets placed before this Court, it transpires that on 10th June, 1975, the direction was given to register the appeal and post for hearing under Order XLI Rule 11 of the C.P.C. After 23rd September, 1975, records were called for and it was mentioned that the appeal will be heard. Nothing is found from the order-sheets that the matter was admitted under Order XLI Rule 11 of the C.P.C. However, postal notice was issued with registered post with A.D. and since thereafter this matter is pending before this Court.

Considering the long pendency of the matter and that the second appeal is not admitted under Order XLI Rule 11 of the C.P.C., this Court does not find any reason for keeping this matter pending in the list further.

Hence, the instant second appeal is dismissed for default.
