The present revisional application has been filed for quashing of the Complaint Case No. 6960 of 2013 which is pending before the learned Metropolitan Magistrate, 8th court, Calcutta under the relevant provisions of Sections 138/141 of the N. I. Act.

Records of this revisional application reflect that dates have been fixed for defence witness. Whole of the trial is over and as such to quash a proceeding at this stage on the averments made in an application or affidavits would be to ignore the evidence which has surfaced in the course of a trial. Learned advocate submits that whole of the amount has been paid. If that be so, it would be for the parties to argue the same at the appropriate stage of the proceedings.

No interference is made by this court at the final stages of the proceedings before the learned trial court.

Accordingly, the revisional application being CRR 48 of 2024 is dismissed.

Pending applications, if any, are disposed of. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court.
