Report by the Inspector-in-Charge, Bankura Police Station dated January 8, 2025, submitted in Court today, be taken on record.

The petitioner's grievance is that in spite of him having lodged complaint earlier regarding disturbance created by the private respondents in smooth plying of his vehicle in the route alignment specified as per the permit and in spite of the police authorities having taken steps to ensure his smooth plying on the route, the private respondents are repeatedly creating disturbance in plying of the vehicle by the petitioner, from the terminating point that is, Bankura Gobinda Nagar Bus Stand.

To that effect, the petitioner has mentioned that since pursuant to his earlier complaint, police protection was allowed to him from November 7,
2024 and November 9, 2024 at Bankura Gobinda Nagar Bus Stand, the private respondents could not create any disturbance in smooth plying of the vehicle of the writ petitioner, during that period of time.

However, since thereafter, the police protection has been temporarily withdrawn.

The private respondents have again started creating similar hindrances. For the reason of the same, the petitioner is not being able to ply his vehicle, in terms of the permit conditions.

However, from the report as submitted in Court, it transpires that the police has taken adequate protective measures, in order to ensure that the writ petitioner is not disturbed by any way to ply buses from the said terminating point of the permitted route alignment, as per the permit conditions. 8.
Heard submissions and perused the records. It appears that the petitioner is plying his vehicle from Jamalpur Bus Stand to Bankura Gobinda Nagar Bus Stand. The allegations are made as regards the private respondents, having caused obstructions and physical assault to the petitioner and his men at Bankura Gobinda Nagar Bus Stand, thereby obstructing smooth operation by him over there. 9.
During the period of police protection, from November 7, 2024 to November 9, 2024, though they remained dormant, but thereafter, they have again started similar kind of mischieves, thereby causing disturbance in smooth plying of vehicle by the petitioner.
10. So far as the private respondents are concerned, who are represented by Mr. Samiran Mandal, leaned counsel, there is no such further incident happened as alleged in this case.
11. Similar submissions have been made by Mr. Pantu Deb Roy, for the State respondent.
12. Considering all as above, the Court finds it proper to dispose of the present case by directing the Officerin-Charge, Bankura Police Station to keep vigil the place about the smooth functioning of the petitioner over Bankura Gobinda Nagar Bus Stand without any disturbance.
13. It is further mentioned that in case it is found otherwise, the said officer shall be at liberty to proceed against the miscreants in accordance with law.
14. Since no affidavit is invited, the allegations contained in the petition are deemed to have been denied by the respondents including the private respondents.
15. With the above observations and directions, the writ petition being WPA 442 of 2025 is disposed of, along with the pending applications, if any.
