-VsThe Chairman and Commissioners of Bankura Municipality Perused the report of the Assistant Registrar IX(in-charge) dated 26th February, 2024.

Pursuant to the order dated 1st September, 2023, administrative notices were issued to the appellants. The notice issued to the appellant nos. 1, 2 and 6 has returned with endorsement "Deceased" on it. The notice issued with regard to the appellant nos. 3, 4 and 5 has returned with endorsement "Addressee Moved" on it. The track consignment report shows that the notice has been delivered to the sole respondent.

The administrative notice as per direction of this Court passed on 31st January, 2024 could not be served upon the learned advocate for the appellants due to non-availability of address and contact number. Be that as it may, this matter is appearing in the list since September, 2023. However, since listing of the matter, none has appeared on behalf of the appellants. None appears on behalf of the appellants.

In view of the above, the present appeal being SA 610 of 1986 along with all connected applications, if any, stands dismissed for default.

Interim order, if any, stands vacated.

Let a copy of this order along with the Lower Court Records be sent to the learned Court below for information in accordance with the rules.

Urgent photostat copy of this order, if applied for, be given to the parties upon compliance of necessary legal formalities.
