In view of the petitioner being aggrieved by the refusal of the distribution licensee to give new electric connection as per the application of the petitioner on the ground of apprehended splitting of load, there is no scope of this court going into the merits of, or adjudicating, such question since, as per the extant Regulations, the Grievance Redressal Officer (GRO) is empowered to decide such disputes.

Accordingly, WPA No. 268 of 2022 is disposed of by granting the petitioner liberty to approach the concerned GRO with the disputes raised by the CESC

Limited in giving new electric connection to the petitioner.

If so approached, the GRO shall decide the same within four weeks from the date of such approach and intimate its decision expeditiously thereafter to the petitioner. The GRO shall so adjudicate in accordance with law and upon giving adequate opportunity of representation, if necessary, to the petitioner and other interested persons. There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
