The victim in her statement recorded under Section 164 of the Code of Criminal Procedure implicates the petitioner. There is an eye witness who recorded a statement under Section 161 of the Code of Criminal Procedure which corroborates the statement of the victim.

Considering the gravity of the offence and the involvement of the petitioner therein as transpiring from the materials in the case diary, we are unable to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner is rejected. CRM (A) 50 of 2023 is dismissed.
