Learned counsel appearing on behalf of the petitioner submits that other than the statement of co-accused there is no other material available against the present petitioner. Learned counsel appearing for the State opposes the prayer for anticipatory bail. He submits that other than the statement of the co-accused, there are statements of witnesses showing that some others fled away from the place of occurrence and a motor bike was left. This belonged to the present petitioner.
Considering the above, the other incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail.
The application for anticipatory bail is, thus, rejected. Urgent Photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
