The grievance of the petitioners pertains to nonholding of elections of the Dongabhanga Nimakpota Samabay Krishi Unnyan Samity Limited, being the respondent no.6.

The matter had been heard and adjourned on 12th January, 2021, 25th January, 2021 and 9th January, 2021 on the ground that the Election Commission needed time to take necessary instructions.

Today, counsel on behalf of the Election Commission fairly submits that there is no objection to the elections of the concerned Co-operative Society being the respondent no.6 being held and the Election Commission will take appropriate steps to conduct such elections.

In view of the fair submissions made on behalf of the Election Commission, WPA 305 of 2021 is disposed off by directing the respondents and more particularly the Election Commission, the State of West Bengal and the Police Authorities to assist in conducting of the election of the respondent no.6 within a period of three months from the date of passing of this order.

It is made clear that all the concerned respondents will give necessary assistance in conducting the election of the respondent no.6 positively within the stipulated time period. In view of the submissions of the Election Commission, the concerned Police Authorities are particularly directed to give all possible assistance in conducting the elections of the aforesaid Society.
