Learned advocate appearing for the petitioner submits that petitioner is in custody for 138 days and till date charges have not been framed. As such the petitioner is unnecessarily detained in custody.
Learned advocate for the State opposes the prayer for bail, produces the statement of the victim under section 164 of the Code of Criminal Procedure as well as the medical documents.
Learned advocate for the defacto complainant is present and opposes the prayer for bail.
I have taken into account the statement of the victim before the learned Magistrate as well as the Medico Legal Examination and on assessment of the same, I am of the view that this is not a fit case for granting bail. Accordingly, the prayer for bail of the petitioner in CRM(M) 97 of 2026 is dismissed.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
