1. Affidavit of service filed in Court today is taken on record.

2. The petitioner claims to be a victim of an offence in respect of which a criminal case is pending consideration before the learned Additional District & Sessions Judge, 3rd Court, Barrackpore.

3. One Sri Jagadish Chandra Majumder, learned Special Public Prosecutor was engaged for defending the State in the subject case.

4. The petitioner submits that, the aforesaid Sri Jagadish Chandra Majumder is of advanced age and because of lack of time he is unable to attend the case diligently and properly.

5. The petitioner has made a request before the learned Legal Remembrancer for engaging any other learned counsel in place and instead of Sri Jagadish Chandra Majumder.

6. From the documents annexed to the writ petition, it appears that the counsels for the State were changed on

earlier occasions at the request of the petitioner. The said Sri Jagadish Chandra Majumder was engaged in compliance with the direction passed by the Court on 3rd February, 2023 in WPA 25523 of 2022.

7. As further request has been made by the petitioner for change of the learned counsel, accordingly, the Legal Remembrancer is directed to engage any other learned advocate from the panel of Public Prosecutors/ Special Public Prosecutors maintained by the State to defend the State in the subject case.

8. A decision shall be taken by the learned Legal Remembrancer at the earliest but positively within a fortnight from the date of communication of this order.

9. It is made clear that Sri Biplab Roy, learned advocate will not be engaged for defending the State in the subject case.

10. The writ petition stands disposed of.

11. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
