Ejaj Akhter ... for the State-respondent(s) Mr. Tapodip Gupta Mr. Suman Bhanja Mr. Golam Ahammed ... for the defacto-complainant Learned advocate appearing for the petitioner submits that in this case the prosecution has already examined eight witnesses and invites the court to assess regarding the evidence of all the witnesses.

P.W.1- Pijush Kanti Mondal, in his evidence stated that while he was on mobile duty at Panchannantala area, he received information that one person had been lying injured near the entrance gate at Murshidabad Zilla Parishad office. The said witness identified the seizure list particularly in respect of the seizure which was effected on 29.10.2024 in respect of recovery of the offending weapon.

P.W.-2, Bablu Sk. is an independent witness who stated that the signature on the carbon copy of the inquest report was his and he identified the signature which was marked as Exbt.3.

P.W.-3, Kuntal Bajpayee who was shown in the inquest report identified his signature in the inquest report. P.W.-4, Nabin Karmakar - ASI of police attached to Berhampore police station, was associated with the dead body challan issued in respect of Berhampore P.S. U.D. Case and carried the dead body to the morgue of the concerned hospital from the emergency department. He identified his signature in the dead body challan.

P.W.-5, Manoj Kumar Das - who was produced before the court, is a seizure list witness as is available from the records.

P.W.-6, Raj Kumar Sarkar who denied of having seen anything regarding the incident.

P.W.-7, Amrita Saha identified her signature in the inquest report.

P.W.-8, Uttam Das also identified his signature in the inquest report.

However, till date, the other witnesses being Purnima Hazra, Mahabuba Khatun, Ganesh Hazra and Tulshi Hazra are left to be examined.

Having regard to the gravity of the offence and the manner in which the deceased was murdered by using a sharp cutting weapon which is a regular instrument available in the household and the post-mortem report corroborating the nature of the injury, I am of the view that, at this stage, this is not a fit case for granting bail to the present petitioner inspite of appreciation and consideration of the materials which have been surfaced in course the evidence of this case.

Hence, the prayer for bail of the petitioner is Rejected.

Accordingly, CRM(M) 98 of 2026 is dismissed.
