Learned advocate appearing for the petitioner submits that the petitioner has been implicated in connection with the instant case on the basis of the statement of the co-accused and the subject matter of the case relates to alleged recovery of 80 bottles of phensedyl from two other accused persons. Earlier, the State opposed the prayer for bail on the ground that there were antecedents of the present petitioner which included five criminal cases.

Learned advocate for the petitioner today has clarified that in the earlier NDPS case he has been acquitted. So far as the other cases are concerned, only one case, there are substantial progress. So far as the rest of the cases are concerned, there is no progress of the case but the petitioner is on bail.

Having regard to the fact that similarly placed accused persons were granted bail by this Court, I am inclined to release the petitioner on bail.

In view of the above, the prayer for bail is allowed. Accordingly, the petitioner viz, Tarikul Islam @ Tarik shall be released on bail upon furnishing bond of Rs. 20,000/-, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Additional District & Sessions Judge, 2nd Court cum Judge, Special Court, under NDPS Act, Murshidabad at Berhampore. If on bail, the petitioner shall be physically present on each and every date so fixed by the learned Special Court and shall not leave the jurisdiction of the district of Murshidabad without prior permission of the learned Special Court. The application for bail, being CRM (NDPS) 58 of 2026 is, thus, disposed of.
