Pursuant to the earlier directions a fresh report has been submitted by the police authorities which reflect that L.R. Record of the suit property was recorded in the name of the respondent nos. 9 to 12. So far as the petitioner is concerned, the petitioner's property measuring about 10 Satak of land is as per C.S. Khatian No. 893 vide J.L. No. 123 and recorded in the name of Radhakanta Mondal. Since two records are reflecting two sets of names and the accusations of the petitioner are relating to forgery of documents for establishing of title over the property, I am of the view that for the sake of convenience, petitioner would better approach the learned jurisdictional Magistrate under section 175(3) of the BNSS. Learned Magistrate would in the circumstances assess and ascertain
regarding the genuinity of the allegations and thereafter pass necessary directions as he deems fit and proper.
With the aforesaid observations WPA 478 of 2025 is disposed of.
Report submitted be kept with the record.
Copy of the report be handed over to the learned advocate appearing for the petitioner.
