Learned counsel appearing for the petitioner contends that despite the petitioner having cleared her electricity dues, the petitioner's representation for getting a permanent electricity connection and for effecting necessary changes in the installations required for such connection are not being acted upon by the West Bengal State Electricity Distribution Company Limited (WBSEDCL).

Learned counsel appearing for the WBSEDCL, in his usual fairness, submits that the petitioner has actually cleared her dues and at present there is no impediment for the WBSEDCL to change the necessary installation for bolstering the permanent connection, which the petitioner is already enjoying.

In view of the submission of learned counsel for the WBSEDCL that the connection given to the petitioner is already permanent, no direction is required to be passed on such score.

Accordingly, W.P.A. No. 336 of 2023 is disposed of by directing the WBSEDCL to replace/install the necessary permanent structures required for strengthening the permanent connection given to the petitioner. Inasmuch as the enhancement of load is concerned, in view of the submission of the WBSEDCL that the existing transformer is sufficient to cater to the requirement of the petitioner, the said load on the transformer is not required to be enhanced.

However, in the event the petitioner seeks an enhancement of the individual load for taking her connection, the petitioner will be at liberty to apply formally for the same.

If such an application is made for enhancement of load of the petitioner, the WBSEDCL shall decide on the same in due course of law as expeditiously as possible.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance of all necessary formalities.
