Ward of the petitioner is scheduled to appear in Madhyamik Examination, 2025 provided Registration Certificate is issued in favour of her allotting registration number.
Learned advocate representing the petitioner as well as learned advocate representing the Teacher-incharge of the school of the ward of the petitioner have jointly submitted that steps were taken in the month of September, 2023 by filling up forms to complete the formalities for obtaining Registration Certificate which would permit the ward of the petitioner to participate in Madhyamik Examination, 2025. It also appears from
Page 20 of the writ petition that the school authority, where the student was studying at the relevant point of time in Class IX, deposited registration fees for 84 students including the ward of the present petitioner. However, Page 21 indicates that in respect of 83 students of the school in question, registration was complete excluding the ward of the petitioner only. Petitioner prays for necessary direction upon the concerned respondent authorities for obtaining Registration Certificate which would enable ward of the petitioner to participate in the ensuing Madhyamik Examination, 2025.
Learned advocate representing the West Bengal Board of Secondary Education submits more alacrity was expected from the school where ward of the petitioner is studying to complete the formalities of registration so that academic interest of the student is not jeopardized. In the present case, according to the Board for a long period of time no steps have been taken by the school authority in order to protect the academic interest of the student and school should be held responsible for not issuing Registration Certificate in favour of the ward of the petitioner.
Having considered the respective submissions made on behalf of the parties and taking note of the letter dated 24th December, 2024 issued by the Teacherin-charge of the school, it appears it has been admitted
by the Teacher-in-charge that it was fault on the part of the school to take steps at right moment as a result whereof till date Registration Certificate could not be issued in favour of the ward of the petitioner. However, due to fault on the part of the school authority academic interest of the student cannot be sacrificed. The concerned authority of the West Bengal Board of Secondary Education is directed to issue Registration Certificate in favour of the ward of the petitioner by seven (7) days from date on compliance of necessary formalities by the school authority. After issuance of Registration Certificate necessary steps are to be taken in offline mode to complete the enrollment of the student which would permit her to participate in the examination. Such procedure shall be completed by seven (7) days thereafter.
Lackadaisical approach of the school authority shall be viewed seriously in future if same is recurred. With the above directions, writ petition stands disposed of.
There shall be no order as to costs.
Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
