The State of West Bengal and another Mr. Partha Sarathi Das Ms. Souraja De Ms. Shanta Sarkar .. for the petitioners Since the petitioners seek expeditious disposal of the application filed under Section 227 of the Code of Criminal Procedure before the learned Judicial Magistrate, 3rd Court, Howrah, the matter may be taken up for consideration without service of notice upon the opposite parties. The opposite parties shall not be prejudiced by an order directing expeditious disposal of the case.

It appears that the petitioners filed an application under Section 227 of the Code of Criminal Procedure before the learned Trial Court on 28th November, 2023 and despite several dates being granted by the learned Trial Court, the application could not be considered.

In view of the above, the learned Trial Court is directed to consider the application under Section 227 of the Code of Criminal Procedure on the next date fixed before him and in the event the same is not possible due to unforeseen circumstances within two weeks thereafter, upon granting reasonable opportunity of hearing to the parties and without granting any unnecessary adjournment to either of the parties, in accordance with law.

CRR 103 of 2025 is accordingly disposed of.
