Learned advocate for the State, on the other hand, draws the attention of the court to the statement of the witnesses particularly that of the child and it seems that the present petitioner is not similarly situated as the other accused persons who have been granted bail.

Additionally, it has been submitted that majority of the witnesses have already been examined and few more witnesses are to be examined by the prosecution.

Having considered the stage of the case; complicity of the present petitioner and the fact that the petitioner is not enjoying the parity as the other accused persons who have been granted bail, I am not inclined to enlarge the petitioner on bail.

Hence, the prayer for bail of the petitioner is Rejected.

Accordingly, CRM(M) 101 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
